CLA362 - The Leasehold Valuation Tribunals (Fees) (Wales) (Amendment) Regulations 2014
These Regulations make amendments to the Leasehold Valuation Tribunals (Fees) (Wales) Regulations 2004 (“the 2004 Regulations”) as a result of the introduction of universal credit by Part 1 of the Welfare Reform Act 2012. Regulation 8 is amended so as allow the receipt of universal credit to be taken into account when determining whether a tribunal fee may be waived. Some minor amendments are also made to the Welsh text of the Regulations so as to align both English and Welsh texts.
Procedure: Negative
Technical Scrutiny
No points are identified for reporting under Standing Order 21.2 in respect of this instrument.
Merits Scrutiny
The following points are identified for reporting under Standing Order 21.3 in respect of this instrument.
These Regulations make an additional change to the Welsh text of the 2004 Regulations as an amendment was made to the English text only by the Secretary of State as part of the Employment and Support Allowance (Consequential Provisions) (No 3) Regulations 2008. It appears that the Department for Work and Pensions was not aware of the need to amend Welsh legislation in both languages.
[Standing Order 21.3(ii) -that it is of political or legal importance or gives rise to issues of public policy likely to be of interest to the Assembly;]
